These Terms of Use ("Terms") govern your installation and operation of the RexyServer software ("the Software," "RexyServer," "we," "us," or "our"). By downloading, installing, or operating RexyServer, you agree to be bound by these Terms. If you do not agree, do not download, install, or operate RexyServer.
Plain English Summary. RexyServer is free software that runs on your own hardware to organize and serve your personal media collection to RexyRead and RexyListen on your Apple devices. RexyServer does not host, stream, or provide any content — you supply your own files. You are entirely responsible for what you put on your server and whether you have the legal right to have it there. Using this software to organize or distribute pirated content is prohibited and violates these Terms. Using this software with third-party metadata APIs (ComicVine, Marvel, etc.) means YOU agreed to those providers' terms when you obtained their credentials — you are responsible for following them.
RexyServer is a self-hosted media server application that you install and run on your own Mac hardware. RexyServer indexes media files that you supply, builds a catalog database, fetches metadata from third-party sources you configure, and serves that catalog and the underlying files to client applications (RexyRead, RexyListen, and others) that you pair with it.
RexyServer is not a content provider, streaming service, media distributor, content delivery network, or cloud service. RexyServer does not host or store media content on any infrastructure we control. RexyServer does not transmit, cache, distribute, or provide access to any media content of any kind on any servers we operate. All media content is stored on the hardware you, the operator, control, and is transmitted only between that hardware and devices that you have paired with it.
You must be at least 18 years of age, or the applicable age of majority in your jurisdiction (whichever is higher), to install and operate RexyServer. RexyServer is intended for adults running self-hosted infrastructure on hardware they own or are authorized to use. You must have the legal right to install, configure, and operate server software on the hardware you intend to use.
Operating RexyServer makes you a server operator. You are solely and entirely responsible for every aspect of how RexyServer is configured, used, and maintained on your hardware. By installing and operating RexyServer, you represent, warrant, and agree that:
RexyServer's developer has no knowledge of, access to, or control over the content in your library, the configuration of your installation, or the network in which your installation runs. We make no representations about, and accept no responsibility for, any content you store or serve through RexyServer.
4. Prohibited Uses and Copyright. RexyServer has zero tolerance for use of the Software in connection with pirated, unlicensed, or illegally obtained content. Using RexyServer to organize, store, or serve pirated content is a material breach of these Terms and may violate applicable copyright law.
You expressly agree that you will NOT use RexyServer to:
RexyServer is designed and intended solely for use with lawfully obtained personal media collections — content that you own on physical media (printed books, comics, CDs), have purchased digitally, scanned from your own physical copies for personal use where permitted by your jurisdiction, or otherwise have the explicit legal right to store and serve for personal use under the laws of your jurisdiction.
Violation of this section is a material breach of these Terms, terminates your license to use RexyServer immediately, and may expose you to legal liability under applicable copyright law. RexyServer's developer reserves the right to cooperate fully with any law enforcement investigation or legal process related to your use of the Software.
RexyServer does not review, screen, monitor, or filter content you add to your library. Content served through RexyServer may include material that is inappropriate for minors, offensive, inaccurate, or otherwise objectionable. You alone are responsible for your media library and for determining whether content is appropriate for yourself, other users of your server, and any members of your household with access to it.
By installing and operating RexyServer, you acknowledge that any objectionable content in your library reflects choices made by you when populating your server, and you agree that RexyServer and its developer bear no responsibility for the nature, legality, or appropriateness of that content.
RexyServer supports multiple user accounts on a single installation. If you create user accounts for other people (family members, housemates, etc.), you are responsible for that operation:
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and operate RexyServer on hardware you own or are authorized to use, for the purpose of serving your personal media library to your own client devices.
This license does not include the right to: (a) redistribute RexyServer or any portion of it; (b) sell, rent, lease, lend, or sublicense access to RexyServer or any data it produces; (c) operate RexyServer as a commercial hosting service for others; (d) use RexyServer's branding or trade dress in other applications; or (e) remove or alter copyright, trademark, or attribution notices in the Software.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REXYSERVER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not warrant that RexyServer will be compatible with all macOS versions, all Mac hardware, all network configurations, or all client app versions. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, any implied warranties are limited to the fullest extent permitted by law.
Metadata for items in your library is fetched from third-party sources you have configured. We make no representations or warranties about:
Third-party metadata providers may modify their terms of service, rate-limit or revoke your API access, change pricing models, shut down their service, or return incorrect or incomplete data. RexyServer is not responsible for any of these events. If a metadata source becomes unavailable or revokes your access, you remain responsible for handling that situation in your installation.
RexyServer stores your library catalog, user accounts, and reading progress in a local SQLite database. While RexyServer is designed with reasonable care, no software is immune from data loss. We make no warranty that data stored by RexyServer will be preserved against corruption, hardware failure, software bugs, accidental deletion, or any other cause. You are responsible for maintaining your own backups.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REXYSERVER AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR INSTALLATION OR OPERATION OF THE SOFTWARE.
THIS INCLUDES BUT IS NOT LIMITED TO: LOSS OF DATA, LOSS OF CONTENT ACCESS, LOSS OF REVENUE OR PROFITS, LOSS OF GOODWILL, DEVICE DAMAGE, BANDWIDTH CHARGES INCURRED BY EXPOSING YOUR SERVER TO THE INTERNET, ANY ACTION BY YOUR INTERNET SERVICE PROVIDER ARISING FROM YOUR OPERATION OF THE SOFTWARE, OR ANY OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL REXYSERVER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SINCE REXYSERVER IS FREE, THIS AMOUNT IS ZERO.
Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless RexyServer and its developer from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from or relating to:
This indemnification obligation specifically includes any claims by copyright holders, content owners, rights holders, metadata API providers, or other third parties arising from your operation of RexyServer.
Because RexyServer's developer does not host, store, or serve any content on any infrastructure we control, it is not possible for infringing content to be hosted by us. If you believe content is being infringed through use of RexyServer, the appropriate party to contact is the operator of the specific RexyServer installation from which that content is being served — not RexyServer's developer.
If you have a copyright concern related to materials within the RexyServer Software itself (for example, icons, images, or default text shipped with the Software), please contact us at rexyviewapp@gmail.com with the subject line "Copyright Notice" and include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material in RexyServer's Software (not an operator's library); (c) your contact information; (d) a statement made under penalty of perjury that you have a good faith belief that the use is not authorized; and (e) your physical or electronic signature.
RexyServer will cooperate fully with any valid legal process or investigation related to copyright infringement by an operator of the Software.
The Software and your use of it are subject to the export control laws of the United States and any other applicable jurisdictions. You agree to comply with all such laws and regulations. You represent that (a) you are not located in a country that is subject to a U.S. government embargo or has been designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. government list of prohibited or restricted parties.
RexyServer uses standard HTTPS encryption for network communications, which is classified as a mass-market product exempt from export license requirements under U.S. Export Administration Regulations.
We may terminate or suspend your license to use RexyServer at any time, with or without cause, with or without notice. You may also stop using RexyServer at any time by quitting the application and removing it from your hardware. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
We may update these Terms from time to time. The Last Updated date at the top of this document reflects the most recent revision, which will appear in new releases of RexyServer. Your continued operation of the Software after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please stop using RexyServer and remove it from your hardware.
These Terms are governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of laws principles. For users outside the United States, nothing in these Terms limits your rights under applicable consumer protection laws in your jurisdiction. Users in the European Union retain all rights afforded to them under EU consumer protection law.
For users in the United States: any dispute arising out of or relating to these Terms or the Software shall be resolved through binding individual arbitration rather than in court, except that you may assert claims in small claims court if your claim qualifies. You and RexyServer waive any right to a jury trial or to participate in a class action. You may opt out of this arbitration agreement by sending written notice to rexyviewapp@gmail.com within 30 days of first accepting these Terms.
For users outside the United States: any dispute may be resolved in the courts of your country of residence or in the courts of the developer's jurisdiction, at your option, to the extent required by applicable law.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
These Terms, together with the Privacy Policy and the Acknowledgements document built into the Software, constitute the entire agreement between you and RexyServer regarding the Software and supersede any prior or contemporaneous agreements, communications, or understandings.
